Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of Modern Day Coach websites, memberships, coaching tools, educational content, programs, and related services (collectively, the “Services”).
Effective date: July 31, 2026
1. Agreement to these Terms
By accessing or using the Services, creating an account, purchasing a membership, joining an organization, or enrolling in a program, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of a team, league, academy, or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.
2. Who we are and what we provide
Modern Day Coach (“MDC,” “we,” “us,” or “our”) provides structured baseball player-development systems, educational materials, practice-planning tools, coaching resources, communication features, and related program offerings.
Parts of the member experience may be powered by UniteHQ, a third-party technology platform. Account creation, login, marketplace purchases, messaging, and certain dashboards may occur through UniteHQ or other service providers. Those platforms may have additional terms that apply when you use them.
3. Eligibility and accounts
- You must be able to form a binding contract under applicable law to create an account or purchase a membership.
- Accounts for youth players are intended to be created and managed by a parent, legal guardian, or authorized adult such as a coach or organization administrator.
- You are responsible for the accuracy of information you submit and for maintaining the confidentiality of your login credentials.
- You are responsible for activity that occurs under your account. Notify us promptly at support@modern-day-coach.com if you suspect unauthorized account access.
4. Memberships, programs, and purchases
Memberships, program registrations, and other paid offerings are subject to the pricing, plan details, and purchase flow shown at checkout or in the applicable offer. Features may vary by plan, organization agreement, or program location.
Unless a specific offer states otherwise, fees are charged when you subscribe, renew, or complete registration. Payment processing may be handled by third-party processors and platforms. You authorize those charges according to the selected plan and the processor’s terms.
We may change pricing, plan features, or availability prospectively. If a material change affects a paid subscription you already hold, we will provide notice as required by law or the purchase platform’s process.
5. Cancellations, renewals, and refunds
Subscription renewals, cancellation controls, and refund eligibility may depend on the product purchased and the platform used for checkout. Where cancellation is available in your account or marketplace settings, you are responsible for cancelling before the next billing period if you do not want to renew.
Unless required by law or expressly stated in a specific offer, program registration, or written agreement, purchases are non-refundable after access has been granted or a program seat has been reserved. If you believe a charge was made in error, contact info@modern-day-coach.com promptly so we can review the request.
6. Nature of the development tools and content
MDC provides educational tools, structured frameworks, and development guidance. The Services do not guarantee player improvement, playing time, recruitment outcomes, or competitive results.
Parent-entered starting profiles and skill ratings create a structured starting point. Unless MDC expressly provides a separate professional evaluation as part of a specific service, those ratings should not be treated as an objective professional evaluation.
Coaches and organizations remain responsible for adapting practice plans, drills, and guidance to their players, facilities, equipment, safety rules, and local requirements.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose
- Misrepresent your identity, role, authority, or relationship to a player or organization
- Upload or share content that is abusive, harassing, defamatory, or that invades another person’s privacy
- Attempt to gain unauthorized access to accounts, systems, or data, or interfere with the operation of the Services
- Copy, scrape, reverse engineer, resell, or commercially exploit MDC content or software except as expressly allowed
- Use MDC materials to create a competing product or to train models using our proprietary content without written permission
We may suspend or terminate access if we reasonably believe these Terms have been violated or if use creates risk for MDC, other users, or the platform.
8. Organization and coach responsibilities
If you administer invites, rosters, or access for a team, league, or program, you are responsible for:
- Inviting only authorized users and managing access appropriately
- Ensuring organization use complies with applicable youth-sports, school, and league rules
- Communicating accurately with families about what MDC does and does not provide
- Obtaining any consents needed to share player or parent information within your organization
9. Intellectual property
The Services, including MDC branding, logos, written content, frameworks, drills, curriculum structure, software interfaces, and design elements, are owned by MDC or its licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services for your personal, family, team, or organizational development purposes as offered.
You retain rights to content you submit, but you grant MDC a license to host, process, display, and use that content as needed to operate and improve the Services and to provide features you enable.
10. Third-party services
The Services may integrate with or link to third-party products, including UniteHQ, payment processors, analytics tools, and communication providers. We are not responsible for third-party services we do not control. Your use of those services may be subject to their terms and privacy policies.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MDC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT RESULTS FROM USE WILL MEET YOUR EXPECTATIONS.
Baseball training involves physical activity and risk of injury. You are responsible for ensuring age-appropriate, safe training environments and for obtaining any medical clearance you deem necessary. MDC is not a medical provider and does not provide medical advice.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MDC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MDC FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.
13. Indemnification
You agree to defend, indemnify, and hold harmless MDC and its owners, officers, employees, and contractors from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, your organization administration, or your violation of these Terms or applicable law.
14. Suspension and termination
You may stop using the Services at any time and may cancel paid subscriptions according to the applicable cancellation process. We may suspend or terminate access if you breach these Terms, if required by law, or if continued access creates risk or operational harm. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
15. Changes to the Services or Terms
We may update the Services and these Terms from time to time. When we update the Terms, we will revise the effective date and may provide additional notice when appropriate. Continued use after an update constitutes acceptance of the revised Terms, except where applicable law requires a different process.
16. Governing law
These Terms are governed by the laws of the United States and the State of North Carolina, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise. Courts located in North Carolina will have exclusive jurisdiction over disputes arising from these Terms, unless applicable law requires a different venue.
17. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or sale of assets. These Terms, together with the Privacy Policy and any specific offer or organization agreement, are the entire agreement between you and MDC regarding the Services.
